1. About These Terms
These terms and conditions ("Terms") govern your use of the website located at www.jamawhat.com ("Website") and the purchase of products from Jamawhat.
By browsing or placing an order through our Website, you confirm that you are at least 18 years of age and agree to be legally bound by these Terms, together with our Privacy Policy and Cookie Policy, which are incorporated by reference.
We may update these Terms from time to time. The version in force at the time you place your order will apply to that order. We will post any changes on the Website.

3.1 Permitted use
You may use our Website for lawful purposes only. You must not use the Website in any way that breaches any applicable local, national, or international law or regulation; that is unlawful or fraudulent; or that harms or is intended to harm any person.
3.2 Intellectual property
All content on this Website, including but not limited to text, graphics, logos, images, product designs, and software, is the property of Jamawhat or its licensors and is protected by UK and international copyright, trade mark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our Website without our prior written consent.
3.3 Accuracy of information
We take reasonable care to ensure that the information on our Website is accurate and up to date. However, we do not warrant that it is complete or error-free. We reserve the right to make changes to the Website and its content at any time without notice.
3.4 Website availability
We aim to make the Website available at all times, but we cannot guarantee uninterrupted access. We may suspend, withdraw, or restrict access to the Website at any time, including for maintenance or technical reasons, without notice or liability.
4. Our Products
4.1 Product descriptions
We have made every effort to display the colours, textures, and details of our products as accurately as possible. However, we cannot guarantee that your device's screen will accurately reflect the true colour of a product. All sizes, weights, and dimensions stated are approximate.
4.2 Availability
All products are subject to availability. We may withdraw or discontinue any product at any time. If a product in your order becomes unavailable after we have accepted your order, we will notify you as soon as reasonably practicable and issue a full refund for that item.
4.3 Pricing
All prices on our Website are displayed in your local currency – as selected on the Website.
We reserve the right to change prices at any time. The price you pay is the price shown at the time you complete your order, except in cases of obvious pricing errors (see clause 5.4).
4.4 Customs duties and import taxes
Orders shipped outside the United Kingdom may be subject to customs duties, taxes, and import fees levied by the destination country. Where applicable, standard customs duties and import tariffs in effect at the time of purchase are included or accounted for at checkout, so that customers are not expected to pay additional charges on delivery for those fees.
We are not responsible for any new, increased, or additional customs charges, tariffs, taxes, or import fees introduced after the order has been placed, including any changes made by government authorities, customs services, or carriers. Any such post-order charges are the responsibility of the recipient and must be paid in order to receive the parcel.
We recommend customers check local import regulations before placing an order, as these may change from time to time. These charges are the responsibility of the recipient. We have no control over such charges and are unable to predict their amount. We recommend that customers based in Europe and the United States check with their local customs authority before placing an order.
For EU customers: since 1 July 2021, all goods entering the EU are subject to import VAT regardless of value. We are not currently registered under the EU Import One Stop Shop (IOSS) scheme; accordingly, EU import VAT will be collected from the recipient by the carrier prior to delivery.
5. Placing an Order
5.1 How to order
By submitting an order through our Website, you are making an offer to purchase the selected products at the prices shown, subject to these Terms. Your order does not constitute a binding contract until we have accepted it (see clause 5.3).
5.2 Account registration
You may purchase as a guest or create a registered account. If you register, you are responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your account. Please notify us immediately if you believe your account has been compromised.
5.3 Order acceptance
After placing your order you will receive an automated order confirmation email. This is an acknowledgement only and does not constitute acceptance. A contract is formed when we send you a separate dispatch confirmation email confirming that your order has been shipped.
We reserve the right to refuse or cancel any order at our absolute discretion, including where:
• A product is out of stock or has been discontinued;
• There is an error in the product description or price;
• We are unable to verify payment authorisation; or
• The order appears fraudulent or in breach of these Terms.
If we cancel your order after payment has been taken, we will issue a full refund within 14 days.
5.4 Pricing errors
If we discover a pricing error before accepting your order, we will contact you and give you the option of purchasing at the correct price or cancelling. If we discover a pricing error after dispatch, we may, at our discretion, require payment of the difference or arrange collection and a full refund.
5.5 Vouchers and promotional codes
Promotional codes and vouchers are subject to any additional terms communicated at the time of issue. Codes may not be combined unless expressly stated. We reserve the right to void a code where we reasonably suspect misuse or where a code was applied in error.
6. Pre-Orders and Limited Edition Drops
6.1 Pre-orders
Where a product is offered for pre-order, the expected dispatch date will be displayed on the product page at the time of ordering. This date is an estimate only and may be subject to change due to production, supply, or logistics delays.
Payment for pre-orders is taken in full at the time of ordering. If a pre-order product is cancelled by us before dispatch, you will receive a full refund within 14 days.
If you wish to cancel or amend a pre-order before it has been dispatched, you may do so at any time prior to the pre-order closing date by contacting us. After the pre-order closing date has passed, orders enter production and can no longer be amended or cancelled. Once dispatched, standard returns rights apply as set out in clause 8. We will notify you of any significant changes as soon as reasonably practicable.
6.2 Limited edition and drop releases
Limited edition and signed products are offered in finite quantities. Once stock is exhausted, no further orders can be accepted. Placing an item in your shopping basket does not reserve it; stock is only secured upon completion of checkout and receipt of a dispatch confirmation email.
Signed items are made to order and/or personalised and therefore cannot be cancelled or returned for change of mind, in accordance with applicable consumer laws.
Returns will only be accepted where items are faulty, damaged, or not as described.
Nothing in this clause affects your statutory rights.
We reserve the right to limit the number of items purchased per customer per drop. Orders exceeding these limits may be cancelled in part or in full, with any overpayment refunded.
6.3 Waitlists
If you join a waitlist for a product, this does not guarantee future availability or priority. We will use reasonable endeavours to contact waitlist members when stock becomes available, but cannot guarantee notification to all registered interest.
7. Payment
7.1 Accepted payment methods
We accept the following payment methods: Visa, Mastercard, Apple Pay, Google Pay. All transactions are processed securely via our payment provider(s) using industry-standard SSL/TLS encryption.
We do not store your full card details on our systems. All payment information is processed securely by PCI-DSS compliant payment providers such as Shopify Payments.
7.2 Currency
Prices are displayed in your local currency. If your card is denominated in a different currency, your bank or payment provider may apply a foreign exchange conversion rate and additional fees, for which we are not responsible.
7.3 Fraud prevention
We carry out fraud screening on all orders. We reserve the right to request additional verification before processing a payment and to cancel orders where we reasonably suspect fraudulent activity. Customers found to have committed payment fraud will be reported to the relevant authorities.
8. Delivery
8.1 Delivery areas
We currently ship to addresses in the United Kingdom, selected European countries, Canada, Australia and the United States. We reserve the right to restrict delivery to certain locations at our discretion.
8.2 Delivery options and timeframes
Estimated delivery timeframes are shown below, at checkout, and in your dispatch confirmation email. These timeframes are provided as estimates only and may vary depending on circumstances outside our control.
Delivery may be affected by, including but not limited to:
• Carrier delays or disruption
• Adverse weather conditions
• Public holidays in the origin or destination country
• Customs clearance procedures
• Force majeure events (see clause 14)
This does not affect your statutory rights under applicable consumer protection laws.
United Kingdom - Standard delivery: 7–10 working days (Monday to Friday, excluding public holidays).
Europe - Standard international delivery: 10–12 working days (Monday to Friday, excluding public holidays). Customs clearance may result in additional delays outside of our control.
United States and Canada - Standard international delivery: 10–15 working days from dispatch (Monday to Friday, excluding public holidays). Delivery times do not include potential delays caused by US or Canadian customs authorities.
Express and next-day delivery services are not currently available.
8.3 Delivery charges
Delivery charges are calculated based on order weight, destination, and selected delivery method, and are displayed clearly at checkout before you confirm your order. We may offer free delivery promotions, which are subject to any additional terms communicated at the time.
8.4 Failed delivery
If a delivery attempt is unsuccessful, our carrier will leave instructions for redelivery or collection. If a parcel is returned to us due to non-collection or an incorrect address provided by you, we will contact you. Additional delivery charges may apply for re-dispatch.
8.5 Risk and title
Risk in the products passes to you upon delivery. Title (ownership) passes to you upon receipt of full payment. We retain a lien over any undelivered goods until full payment has been received.
8.6 Lost or delayed parcels
If your order has not arrived within 30 working days of the estimated delivery date, please contact us. We will liaise with our carrier and, where a parcel is confirmed lost in transit, offer you a replacement (subject to availability) or a full refund.
9. Returns, Refunds, and Cancellations
9.1 UK customers – your statutory rights
If you are based in the United Kingdom, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel your order within 14 days of receiving your goods without giving any reason (the "Cooling-Off Period").
To exercise this right, you must notify us of your decision to cancel before the Cooling-Off Period expires by:
• Emailing us at contact@jamawhat.com; or
You must return the goods to us within 14 days of notifying us of your cancellation. You are responsible for the cost of return postage unless the item is faulty, not as described, or we agree otherwise.
We will issue your refund within 14 days of receiving the returned goods. Refunds will be made using the same payment method as the original transaction. A restocking fee of up to 10% may be deducted from refunds for non-faulty returned items to cover handling, inspection, and processing costs. This fee will not apply to items that are faulty or damaged. All returned items must be unworn, unused, and in original condition to qualify for a refund.
9.2 EU customers – your statutory rights
If you are based in the European Economic Area, the EU Consumer Rights Directive 2011/83/EU (as implemented in your country) gives you a 14-day withdrawal right on the same basis as described for UK customers above. The refund will be issued within 14 days of us receiving the returned goods.
Please note that you will be responsible for return shipping costs, and any outbound shipping charges paid at the time of order are non-refundable unless the full order is cancelled within the withdrawal period. A restocking fee of up to 10% may be deducted from refunds for non-faulty returned items to cover handling, inspection, and processing costs. This fee will not apply to items that are faulty or damaged. All returned items must be unworn, unused, and in original condition to qualify for a refund.
9.3 US customers – our returns policy
US customers do not have the same statutory cancellation rights as UK or EU consumers, and we do not accept returns for change of mind on made-to-order items. If your item arrives faulty, damaged, or not as described, you are entitled to a replacement or refund under applicable law.
9.4 Australia customers – our returns policy
Australian customers do not have the same statutory cancellation rights as UK or EU consumers, and we do not accept returns for change of mind on made-to-order items. Under Australian Consumer Law, if your item arrives faulty, damaged, or not as described, you are entitled to a repair, replacement or refund.
9.5 Canada customers – our returns policy
Canadian customers do not have the same statutory cancellation rights as UK or EU consumers, and we do not accept returns for change of mind on made-to-order items. Under applicable Canadian consumer protection laws, including provincial consumer protection legislation where applicable, if your item arrives faulty, damaged, or not as described, you are entitled to a repair, replacement or refund.
9.6 Conditions of return
To be eligible for a return, items must be:
• Returned in their original, unworn, unwashed condition; and
• Returned in appropriate packaging to prevent damage in transit.
We reserve the right to refuse a refund where goods have been used, damaged or washed, unless the return is due to a defect.
9.7 Exclusions
The following items are excluded from our returns policy (except where faulty or not as described):
• Items marked as final sale or non-returnable at the time of purchase;
• Limited edition items (see clause 6.2);
• Customised or personalised items made to your specification;
9.8 Faulty or incorrect items
If you receive an item that is faulty or damaged, please contact us within 14 days of delivery with your order number and photographic evidence of the issue.
All items are quality checked before dispatch and securely packaged. However, if your item arrives faulty or damaged (including damage in transit), we will resolve the issue by offering a replacement, repair, or full refund, in accordance with your statutory rights under the Consumer Rights Act 2015 (UK) or applicable consumer protection laws in your country.
Where a return is required, we will either provide a prepaid return label or reimburse reasonable return shipping costs.
9.9 Exchanges
We do not offer a direct exchange service, as all items are made to order and are only produced once an order has been placed. If you wish to receive a different size, color, or design, you will need to place a new order. For eligible returns, you may return your original item in accordance with our Returns Policy for a refund and then place a new order for the desired item. This does not affect your rights in relation to faulty, damaged, or incorrect items, for which we will offer a replacement or refund where appropriate.
10. Consumer Rights and Statutory Guarantees
Nothing in these Terms affects your statutory rights as a consumer. Under the Consumer Rights Act 2015 (UK), goods must be of satisfactory quality, fit for purpose, and as described. If they are not, you have the right to a repair, replacement, or refund.
For EU consumers, the EU Sale of Goods Directive (2019/771) provides a minimum two-year guarantee period from the date of delivery. Where you benefit from the two-year statutory guarantee under your local law, this applies in addition to our returns policy.
For US consumers, we do not offer any additional warranty beyond the statutory product liability protections available under applicable state and federal law. Our products are covered by an implied warranty of merchantability to the extent required by law.
11. Limitation of Liability
11.1 What we are not responsible for
To the fullest extent permitted by applicable law, we exclude our liability for:
• Loss of profits, loss of business, business interruption, or loss of data;
• Indirect or consequential losses arising in connection with your use of our Website or products;
• Losses caused by events outside our reasonable control (see clause 14); and
• Losses arising from your failure to comply with these Terms.
11.2 Our total liability
Subject to clauses 11.3, our total liability to you in connection with any order shall not exceed the total price paid by you for the relevant product(s).
11.3 Liability we cannot limit
Nothing in these Terms limits or excludes our liability for:
• Death or personal injury caused by our negligence;
• Fraud or fraudulent misrepresentation;
• Any breach of the terms implied by sections 12–15 of the Sale of Goods Act 1979 (title and quiet possession);
• Any breach of sections 9–11 of the Consumer Rights Act 2015 (quality, fitness, and description); or
• Any other liability that cannot be excluded by law.
12. Intellectual Property
The Jamawhat name, logo, and all trade marks displayed on our Website and products are the registered or unregistered trade marks of Jamawhat or our licensors. You must not use our trade marks without our prior written consent.
All product designs, artwork, and creative content associated with our clothing and merchandise ranges remain the exclusive intellectual property of Jamawhat. Purchasing a product does not grant you any rights to reproduce or commercially exploit those designs.
If you believe that any content on our Website infringes your intellectual property rights, please contact us at contact@jamawhat.com with details of the alleged infringement.
13. Privacy and Your Personal Data
We take your privacy seriously. Our Privacy Policy, available at https://jamawhat.com/policies/privacy-policy , explains how we collect, use, store, and protect your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
By placing an order, you acknowledge that we may process personal data relating to you as described in our Privacy Policy, including sharing data with third-party service providers (such as payment processors and delivery carriers) as necessary to fulfil your order.
For EU customers, your personal data may be transferred to and processed in the United Kingdom. Such transfers are made on the basis of an adequacy decision by the European Commission (or alternative transfer mechanisms where applicable).
For US customers, please refer to our Privacy Policy for information about your rights under applicable US state privacy laws (including the California Consumer Privacy Act 2018 where applicable).
For Australian customers, please refer to our Privacy Policy for information about your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), where applicable.
For Canadian customers, please refer to our Privacy Policy for information about your rights under applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), where applicable.
14. Events Outside Our Control (Force Majeure)
We will not be in breach of these Terms or liable for any delay or failure to perform our obligations where such delay or failure results from causes beyond our reasonable control, including but not limited to acts of God, strikes, lockouts, industrial disputes, pandemic or epidemic, war, terrorism, civil unrest, fire, flood, storm, government restrictions, port congestion, or carrier disruption.
In such circumstances, we will take reasonable steps to minimise any delay or disruption. Where the event continues for a prolonged period, we may cancel affected orders and issue a refund. This clause applies to the fullest extent permitted by applicable consumer protection law in the United Kingdom, Europe, United States, and Canada.
15. Governing Law and Dispute Resolution
15.1 UK and international customers
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by and construed in accordance with the laws of England and Wales.
Subject to clauses 15.2 and 15.3, the courts of England and Wales shall have exclusive jurisdiction to resolve any dispute or claim.
15.2 EU consumers
If you are a consumer resident in the European Union, you may also benefit from mandatory provisions of consumer protection law in your country of residence. You may bring proceedings in the courts of your country of residence.

15.3 UK alternative dispute resolution
We are committed to resolving disputes fairly. If you have a complaint, please contact us first at contact@jamawhat.com
If we are unable to resolve the issue, we may refer the matter to an approved alternative dispute resolution (ADR) provider. Details are available upon request.
15.4 US customers
If you are based in the United States, nothing in these Terms limits your mandatory rights under applicable federal or state consumer protection laws.
16. General Provisions
16.1 Entire agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us in relation to your use of the Website and the purchase of products, and supersede all previous agreements, understandings, and representations.
16.2 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
16.3 Waiver
Our failure to exercise or enforce any right under these Terms shall not constitute a waiver of that right.
16.4 Assignment
We may transfer our rights and obligations under these Terms to another organisation, for example in the context of a sale of our business. We will always notify you in writing if this happens. You may not transfer your rights or obligations under these Terms to another person without our prior written consent.
16.5 Third-party rights
These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
16.6 Product Information, Pricing & Availability
All features, specifications, products, prices, discounts, promotions, and offers described on our Services are subject to change at any time without notice. All products are subject to availability. We reserve the right to limit quantities per order and to refuse or cancel orders where necessary, subject to applicable law.
In the event of a pricing error, we reserve the right to cancel any affected orders.
We have made every effort to display product colours and details accurately; however, we cannot guarantee that your device will accurately reflect actual product appearance.
We do not guarantee that product descriptions, pricing, or other content on the Services is accurate, complete, or error-free. To the fullest extent permitted by law, all information is provided “as is” without warranties of any kind.
Nothing in this clause affects your statutory rights.
16.7 Updates to these Terms
We may update these Terms from time to time. The updated version will be posted on the Website with a revised “Last updated” date.
Where changes are material, we will take reasonable steps to notify you. Your continued use of the Website or placement of an order after changes take effect constitutes acceptance of the updated Terms.
